The Digital Services Act and Digital Markets Act: a new digital future for Europe?
On 15 December, the European Commission presented its anticipated digital package setting new rules to regulate digital platforms and services. The package includes two new proposals: the Digital Services Act and the Digital Markets Act, aimed at better protecting consumers and their fundamental rights online as well as in the physical world. Under the Digital Services Act (DSA), binding EU-wide obligations will apply to all digital services that connect consumers to goods, services, or content, including new procedures for the faster removal of illegal content. The DSA sets out harmonised rules defining and prohibiting those unfair practices by gatekeepers and provides an enforcement mechanism based on market investigations.
